Thanks for the time, the Supreme Court was better for your time

Some people have said that Supreme Court Justice Sandra Day O'Connor's resignation Friday was a bombshell. I thought the only bombshell was that she was the only one not to resign.

I think that O'Connor will remember well as the first female Supreme Court Justice. She lease some pretty big shoes to fill. Twenty-Five years after he appointment the world of law is a different place. Now women are almost half of the students entering law school. I think she is leaving an amazing legacy.

I think it is good that Bush has not announced his nominee for this opening yet. It will be a real fight. There is a good chance that many people will get a blood nose over this nomination. It is good that O'Connor will have a few days for people to remember her before the real news circus starts.

The New American Religion

I have been watching the Situation with Tucker Carlson at work lately. Carlson is a bit of a goof-ball. The show is okay, but it really just about his opinion. The show could be a lot better. They do not spend enough time on each topic. He did say something that really caught my ear.

CARLSON: I think that's totally rational. But as a country, as the country becomes less religious, it replaces traditional religion with health. We worship physical health. And so in place of the traditional sins, we have sins against the body. And smoking is the key one.


When I first heard this I thought it was a amazing idea. I have friends who thing smoking is a sin. I also know people who think fat people are morally deficient.

After I thought about it I came to a different realization. No matter what people think about religion, humans are innately moral. We want codes set up to tell us what is right and wrong. Even if people move away from traditional religions, they are always going to find something to build that code around. People build the code around health, politics, social values, sexuality, or anything you can think about.

This means even if you can get away from religion you can not get away from people looking down at you. I think this is something you will always have with human beings. We are always willing to group together and look down at people not in our group. The real question is how many laws should we make to effect the people we look down upon?

I just watched Ghostworld. I was thinking about music recorded on 78s. My mother still has a large collection of 78s that she never listens to. I was really suprised when I found thiscollection of 78s on MP3. There are some cool tracks here.

Flickr, Flickr!

Or why hasn't anyone deleted GarageBand from Rich's iBook




Last night was the flickr meetup. This time there was actually Flickr people at the coffee shop and not just 9/11 conspiracy theorist. We had a good time. Courtneyp brought a couple of posters like the flickrverse . Jonchan, Klugarsh, lissabird, Kris247, Wirehead, and bjorke were all there.

  • We talked about the kinds of flickr games we could plan. I liked the idea of starting a Photo Tag group. The idea is that you would make someone "IT" by posting their picture. I guess that we would have to make rules. I wonder what a good base would be.
  • Bjorke reminded us that mobbing everyday people like the paparazzi would be harassment.
  • Wirehead liked the idea of a photo flashmob group. I thought it might be more efficient if we flashmob carpooled.
  • Wirehead also had the idea of Flickr Shenanigans. Every week someone would post a challenge.

    For the second meet up in a row we recorded a song. Even though Antwon is not on this recording is still by Antwon and the Antwonettes. Here is Our Flickr song. It is not as good as Naked Bea, but it has more production. The words were by Wirehead and Klugarsh is the human beatbox/camera shutter.

    Kelo and Motivations

    By now, I expect that most people know about the Recent Supreme Court Ruling in the case of Kelo et al v. City of New London. This case tested the limits of the Eminent Domain and the Fifth Amendment.

    I wrote a big long post about this ruling. I found way to excuse the Supreme Court for the decision. I found ways that it was okay. After thinking about it for a few days I am not sure what I think. I will not know until it has been in place for a little while.

    What I know is that I am not surprised by the ruling. I can see the political thought behind it. If I strictly look at the letter of the Fifth Amendment I can see why the Justices were able to rule this way. Most people are worried about how the outcome will be used. That is why they say the court got it wrong.

    Here is the text of the Fifth Amendment.

    No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; nor shall any person be subject for the same offence to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.


    The problem is that state and local governments are addicted to tax revenue. We want our government to do so much for us. We do not want to pay for what they do for us. Every day this year I have heard someone complain about not getting money in the California budget. If the only thing we can do about the issues that face us is have government throw money at those problems, they will try to generate those taxes no matter what the effect.

    Many people I talk to about this issue have no problem with land being taken for roads or schools. They are afraid that letting land being taken for private development will lead to abuse. The problem is that abuse happens even with public land taking. Both the Cross-Bronx expressway and the Century Freeway are examples of these abuses.

    The Supreme Court got put the responsibility at the level of state government. This means we have work to do if we do not like this decision. If we are worried about the kind of people who are in local politics we need to work on the state level. In California we can even go to the ballot if we have to.

    For too long, many Americans have been looking toward the Supreme Court to protect them. I have been seeing this as a lazy way to see our democracy. We need to take our case to the legislators. Politicians spend millions of dollars to get our votes. We need to be better at extending our power as citizens.

    I found two blog entries that I want to share on this topic. I think both of them make great points. Even if you do not like this ruling, it is not enough to throw up your hands and say that you lost your rights. Now is the time to make your voice heard. We have to be willing to work hard to get the country we want. It is not enough for us just to go to the ballot and hope that is enough.

    It probably is the moment to start paying closer attention to City Council elections which many people, myself included, tend not to scrutinize much. Those people have real power and it's worth paying attention.

    The lesson here, again, is that the Constitution does not provide a remedy for every bad public policy. Combining upper-class tax cuts with increased pork-barrel spending, like the current administration is doing, is awful public policy, but it's constitutional, and the same goes for Robert Moses' grandiose road-building schemes.

    I think that someone has put up a web site about Floating Cubans. The site is really about the cars that people have converted to boats, trying to get to the U.S. I think that these are great boats; I was upset that the Coast Guard destoryed them. I think anyone who can turn an old car into a boat is someone we want living and working here.

    Reason #1034 to love baseball

    My sister sent me a story about the Moonlight Graham's 100th Anniversary. He was the real life player featured in Field of Dreams.

    Dr. Archibald "Moonlight" Graham: Well, you know I... I never got to bat in the major leagues. I would have liked to have had that chance. Just once. To stare down a big league pitcher. To stare him down, and just as he goes into his windup, wink. Make him think you know something he doesn't. That's what I wish for. Chance to squint at a sky so blue that it hurts your eyes just to look at it. To feel the tingling in your arm as you connect with the ball. To run the bases - stretch a double into a triple, and flop face-first into third, wrap your arms around the bag. That's my wish, Ray Kinsella. That's my wish. And is there enough magic out there in the moonlight to make this dream come true?


    Other sports do not have this kind of history or inspire this kind of fiction.
